The US Securities and Exchange Commission has launched an inquiry into Situational Awareness, the AI-focused investment fund founded by former OpenAI researcher Leopold Aschenbrenner, according to a report by The New York Times.
The investigation follows a sharp July 2026 market downturn across artificial intelligence equities that triggered severe portfolio drawdowns for the high-profile fund.
Scope of Subpoenas and Banking Relationships
Federal regulators have issued subpoenas to multiple financial institutions that maintained business relationships with Situational Awareness. The regulatory inquiries concentrate on banks and prime brokers that provided financing facilities, extended leverage, and oversaw the fund's trading execution.
The SEC instructed participating financial institutions to preserve all records, communications, and transaction logs related to the fund. The regulatory agency has not filed formal allegations or accused Situational Awareness, its leadership, or its counterparties of statutory wrongdoing.
In a statement provided to The New York Times, Situational Awareness stated that regulatory reviews of prominent investment funds are routine industry practice and confirmed it intends to cooperate fully with all information requests from authorities.
Volatility Across Concentrated AI Positions
Situational Awareness launched in 2024 following Aschenbrenner's departure from OpenAI's Superalignment team, quickly attracting institutional capital by executing concentrated long strategies across the AI supply chain, semiconductor manufacturers, and cloud infrastructure providers.
The fund experienced rapid capital appreciation during the early 2026 expansion in AI valuation multiples. However, a tech sector correction in late July 2026 resulted in steep valuation compressions across leveraged positions, causing substantial capital impairment and forcing defensive portfolio rebalancing across its holdings.
The SEC inquiry highlights increasing regulatory attention on private funds managing leveraged, highly concentrated portfolios tied to generative AI infrastructure and foundation model capitalization.
